InterCloud SAS, a French « société par actions simplifiée » with a capital of 2.432.124,15 euros, having its registered office at 88-90, Boulevard de Sébastopol in Paris (75003), registered under the number RCS Paris 529 026 486, publishes a website (hereinafter the « Site ») at the URL address or any URL that replaces it and allows you to benefit from the Site intercloud.com.
Use of the Site made available to you by InterCloud implies compliance with these General Terms and Conditions of Use.

1. Object

The purpose of these General Terms and Conditions of Use is to define the contractual relationship between you and InterCloud regarding access to and use of the Site.

Access to the Site is free and is not subject to prior registration.
Access to the Service (which means a subscription to the Newsletter and, more generally, all the services offered by InterCloud) implies subscription on your part. To register for the Service, you must (1) complete the form containing the mandatory information (2) accept these General Terms and Conditions of Use.

3. Processing of Personal Data

When using the Site, you may be required to provide InterCloud with personal data concerning you in order to benefit from the Site and the Service (in particular, your surname, first name, e-mail address, browsing data, and computer equipment identifiers such as IP address). The processing of this data is necessary for the performance of the Service provided by InterCloud.
The processing of this data is carried out in accordance with the regulations applicable to the protection of personal data and in particular, the Loi Informatique et Libertés (Data Protection Act) of 6 January 1978 as amended and European Regulation 2016/679 of 27 April 2016 relating to the protection of personal data and entered into force on 25 May 2018 (hereinafter « the applicable regulations »).
These data are intended for InterCloud personnel and its subcontractors providing the Site and Service, in compliance with applicable regulations. Certain data may also be accessible to public bodies, court officers, and/or government officers in order to comply with any judicial or administrative request to which InterCloud is required to respond.
Your data are used for the administration and management of the Site and the Service as well as for audience measurement and commercial prospecting purposes.
InterCloud may send you, in compliance with the regulations applicable to the protection of personal data, by any means, information enabling you to know better InterCloud’s services as well as commercial proposals.
Your personal data will be retained by InterCloud during the statutory retention and limitation period.
You are informed that access via links on this Site to websites published by third parties is made in accordance with the general conditions of use of the said third-party sites.
In accordance with the applicable regulations, you have at any time various rights relating to data concerning you (access, rectification, deletion, objection, limitation to processing). InterCloud and its contractors place cookies on your computer. These cookies allow you to connect to the Site and use the Service, to establish audience measurements. The Site, including all text, illustrations, videos, images, sounds, data, databases, and programs, including software technology and, more broadly, all original works comprising the Site are protected by intellectual property rights and other rights that InterCloud owns or is authorised to use.
Except in cases authorised by law and without prior authorisation from InterCloud, any reproduction and representation of the Site and its content, any extraction of data is prohibited and constitutes an act of infringement punishable under civil and criminal law.

7. Responsibility

InterCloud declines all responsibility in the event of use that does not comply with these General Conditions of Use.

8. Suspension

InterCloud reserves the right to suspend all or part of the Site temporarily and/or the Service for reasons related to the security of the Site.

9. Translation

The present General Terms and Conditions of Use are established in the French language. In the event of a dispute, the French version will prevail.

10. Applicable law – Competent jurisdiction

You expressly acknowledge that only French law is applicable.
Before any case is referred to a court, you undertake to inform InterCloud of any difficulty and to seek an amicable solution to the dispute.
If that fails, the disputes will be submitted to the competent courts within the jurisdiction of Paris, including in summary proceedings or on request, notwithstanding an appeal in guarantee or plurality of defendants.
